The Protection of Civil Rights and the Recognition and Enforcement of Interregional Judgments in Civil Matters in China

The protection of civil rights is closely linked to the enforcement of judgments. Similarly, the enforcement of judgments is closely related to the realization of constitutional functions. The Basic Laws of the HKSAR and the MSAR are established in accordance with the Constitution of China. Therefore, the effective enforcement of judgments directly impacts the implementation of these two Basic Laws. The ratification and implementation of the International Covenant on Civil and Political Rights (ICCPR) in China will significantly affect the recognition and enforcement of interregional judgments in civil matters. In order to implement the International Covenant on Civil and Political Rights, our country should take swift action to strengthen the implementation of the Arrangement on Judgments between the Mainland and Hong Kong, as well as the Arrangement on Judgments between the Mainland and Macau in order to better uphold the principles and spirit of the Covenant.”
