Abstract

In recent years, the mixed employment between affiliated enterprises in Mainland China has been an important factor behind labor disputes, especially in the Guangdong-Hong Kong-Macao Greater Bay Area. Hence it is necessary to further clarify the legal basis of these disputes and explore effective solutions. In this regard, it should first start with determining legal definition and judging criteria of affiliated enterprises and mixed employment, then clarifying legal position for labor dispute of mixed employment between cross-border affiliated enterprises. In the third place, “piercing the corporate veil” and “integrated enterprise test” would establish legal basis and provie solution path of labor disputes of mixed employment between cross-border affiliated enterprises in the Greater Bay Area. At last, this study would provide theoretical support and practical suggestions for follow-up work of relevant departments.
